This was a case where the injured man’s auto insurer denied his PIP medical benefits, and the man was forced to sue his own insurance company. She was the passenger in a car that was rear-ended while stopped at a traffic light. Our client had a pre-existing condition called spondylolysthesis that caused her vertebrae to be pushed forward. The condition was aggravated in the collision. $400,000 settlement on behalf of an automobile driver who collided with a cement truck. The at fault driver took a left turn in front of our client, causing her to hit the vehicle head-on sending her flying over the top of the truck. The at fault driver initially denied fault for this accident. Our client had multiple fractures to her pelvis, hips, legs, arms, wrist and hands. $300,000 settlement on behalf of a man in a low speed rear-end car accident causing severe injuries to his neck and back due to his position on impact. There was minimal property damage to both vehicles. He was leaning forward and twisted back looking over his left shoulder to view oncoming traffic when he was struck. The injured woman had soft tissue injuries and impingement syndrome of the left shoulder. Her demand prior to binding uninsured motorist arbitration was $100,000 (policy limits). The defendant’s final offer was $35,000. $200,000 policy limit settlement on behalf of a Washington man who was involved in single car drunk driving crash. The injured man was a passenger in a vehicle driven by a friend. The two had both been drinking that evening. The driver missed a corner and rolled the vehicle, throwing the injured man from the vehicle. The client suffered numerous injuries including multiple spinal fractures and a brain injury. $107,353 jury verdict in a case where a man suffered soft tissue neck injury from a "low-impact" motor vehicle accident. There was no visible damage to the vehicles after impact and the property damage estimates for the vehicles were $16.00 and $400.00 respectively. The insurance company refused to offer anything on this case because its attorneys hoped the jury would award nothing due to the minor property damage. $100,000 settlement during a trial for a driver who suffered back and neck injuries in a car accident where he was rear-ended. The defendant’s insurance company offered to settle prior to trial for the amount of the medical bills plus $15,000. After the trial began the defendant's attorney offered to settle for $60,000. Following the first day of trial the defendant offered $80,000. After two days of trial, defendant’s attorney offered to settle for $100,000 the full policy limits. Confidential settlement on behalf of a man involved in a rear end accident. Our client suffered soft tissue injuries causing chronic pain and disruption of his life. His insurance company wrongly denied payment of some of his medical bills and we were able to get a higher settlement due to their “bad faith”. Construction Site Accidents$1.8 million settlement on behalf of an Oregon construction worker who was severely injured while working on a new residential construction site. While working on the second floor, he was hit by a tipping stack of sheetrock that had been dangerously resting in a walkway and propelled through the temporary guardrail landing head first on the floor below. He sustained life-altering injuries including permanent paralysis from the waist down. Plaintiff was not able to make a future wage loss claim as he was an undocumented worker at the time of his injury. The construction companies argued that the worker caused his own injuries. A young woman was severely injured when she was run over by a speedboat. She was swimming towards the back of the boat to board it when the boat operator accidentally reversed the engine. The woman sustained life threatening wounds to her abdomen and legs from the boat’s propeller. $98,509 Jury and Attorney Fee Award on behalf of an elderly blind woman injured when she fell in a hole due to a dangerous floor surface in an attic. The landlord was aware of the missing boards and did nothing to fix them. Confidential Settlement on behalf of a young child attacked by a dog. The child sustained a broken jaw and required hundreds of stitches. Confidential Settlement on behalf of a woman who suffered a fractured knee and wrist after tripping and falling on a stair in an apartment complex she was visiting. Featured Case Summaries$626,500 Settlement Negotiated at MediationOur client’s father was unnecessarily killed while he worked on a construction site at OHSU. He was walking along the only exit route from the site when he was crushed in a "pinch point" between the counterweight of a large track mounted drill rig and a concrete wall adjacent to the walkway. He died shortly after the accident. The company failed to barricade, tape off, or otherwise warn workers against walking in the unsafe "pinch point" area. The man’s children are left without their dad due to this negligent act. $465,960 Jury AwardOur client was working as a traffic control supervisor on a MAX light rail construction site around midnight when she tripped over an unmarked obstruction protruding several inches from the sidewalk and fell on her head and knees. The obstruction was a 2x4 piece of wood that had been left on the sidewalk and had no warning devices set up to protect our client or the other workers from this obstruction. It was impossible to see it as it was dark out due to the late hour. Our client suffered serious injuries to her neck including a herniated disc and spinal cord compression requiring urgent surgery to repair. The at-fault company refused to accept responsibility and the insurance company claimed that her neck problems and severe pain were due to a chronic degenerative disease and did not result from the accident.
